Learning outcomes
|
Within the framework of the course Administrative Procedural Law, students are expected to understand the procedures, processes, and practices of public administration bodies that implement diverse, component public administration activities, with an emphasis on supporting sustainability and fulfilling specific sustainable development goals (SDGs). It can be said that public administration (unlike the legislative or judicial branches) fulfills tasks and objectives in the form of a variety of activities, such as administrative acts, certificates, opinions, statements, registration or record-keeping tasks, as well as measures of a general nature or the conclusion of public law contracts. This subject focuses primarily on the procedural aspects of their implementation. The course emphasizes, first and foremost, a theoretical understanding of the subject matter. That is, students will acquire knowledge concerning the implementation of various procedural processes of administrative authorities, within a broader European and constitutional context and taking into account aspects of sustainability in these activities. The subject of study will therefore be both the basic principles and rules relating to public administration procedural practices and the individual legal institutions of administrative procedural law at all stages of the proceedings (process). In order for a specific output to be lawful and factually correct, the process of its adoption and issuance must be carried out in accordance with the law, and the final output (e.g., a permit, opinion, or measure of a general nature) must meet all legal requirements (in terms of content, form, competence, and external form). Students will draw on this knowledge from legal regulations, professional literature, other professional materials, and case law (both Czech and European). Secondly, the aim of the course is to teach students to apply the acquired knowledge in practice, i.e. to acquire skills consisting in the interpretation and application of administrative procedural law standards in practice. They will be able to conduct specific procedures or proceedings leading to the issuance of some form of public administration activity. They will use these skills not only in classic procedures and proceedings relating to administrative law (culture administration, health care, internal administration, transport administration, building administration, and others), but also in other sectors where administrative law is used in a supporting role (e.g., environmental law, social security law). Students will acquire the ability to comprehensively manage legal affairs in the field of public administration, in particular the ability to prepare and draw up legal documents, submit documents to public authorities, and represent clients in proceedings before these authorities, but also, conversely ? that is, to obtain, collect, and evaluate supporting documents and prepare draft decisions and other acts and forms of public administration. Furthermore, they will be able to critically work with case law, in particular that of administrative courts and the Constitutional Court, or European courts. The aim is also to support students' ability to identify legal problems and propose justified solutions, i.e., to strengthen students' critical thinking and creative and open approach to solving legal problems.
After completing the course, students will be able to: 1. Identify appropriate forms of public administration activities and apply procedural steps leading to their implementation in practice with regard to sustainability, contributing to the fulfillment of SDG 16: Peace, Justice, and Strong Institutions. 2. Prepare legal acts of an abstract and concrete nature and legal strategies supporting sustainable goals in accordance with legal and ethical standards, contributing to SDG 11: Sustainable Cities and Communities and SDG 16: Peace, Justice and Strong Institutions. 3. Analyze and interpret specialized legal texts related to the topic, including the case law of Czech and European courts, with reference to SDG 4: Quality Education and SDG 16: Peace, Justice and Strong Institutions. 4. Address complex procedural legal situations related to sustainability, analyze, formulate, and present (orally and in writing) legal arguments and counterarguments, adapt to changes in public administration legislation supporting SDG 4: Quality Education and SDG 16: Peace, Justice, and Strong Institutions. 5. Cooperate in resolving procedural legal situations with public authorities, the private sector, and civil society, with reference to SDG 17: Partnerships for the Goals.
