Learning outcomes
|
The course General Administrative Law 2 builds on the knowledge and skills acquired in the course General Administrative Law 1, further deepening and developing them. Students should understand, in particular, the so-called legal guarantees in public administration. These are also key to the proper fulfillment of the Sustainable Development Goals (SDGs). Public administration has the potential to regulate a range of activities of natural and legal persons, i.e., to authoritatively interfere with the rights and obligations of private law entities. At the same time, it should fulfill the role of public service. It is therefore crucial that the law has mechanisms in place to ensure control and supervision of its activities and, where necessary, to remedy the situation, i.e., to remove the illegal situation, provide compensation for damages, or punish the "culprit" of this situation. In this course, students will therefore learn about the individual mechanisms for ensuring legality in public administration, their interrelationships, and the process of their application.
1. Navigate the system of legality guarantees in public administration, distinguish between their types, and correctly apply them to individual situations and practical examples, with reference to the fulfillment of SDG 16: Peace, Justice, and Strong Institutions. 2. Apply institutions that fulfill the so-called internal and external control in public administration, contributing to SDG 11: Sustainable cities and communities and SDG 16: Peace, justice, and strong institutions. 3. Implement the process of administrative supervision in various sectors of public administration, contributing to SDG 16: Peace, Justice and Strong Institutions. 4. Respect the principles of fair trial in the context of the constitutional order of the Czech Republic and the European Convention (Article 6) in the exercise of public administration, contributing to SDG 16: Peace, Justice and Strong Institutions. 5. Analyze and interpret specialized legal texts related to the topic, including the case law of Czech and European courts, formulate and present (orally and in writing) legal arguments and counterarguments, adapt to changes in public administration legislation, with reference to SDG 4: Quality Education and SDG 16: Peace, Justice and Strong Institutions. 6. Cooperate in the performance of control and supervisory activities with public authorities, the private sector and civil society, with reference to SDG 17: Partnerships for the Goals.
