Course content

LECTURE TOPIC 1. Economic competition term, Unfair competition term, the historical development of the Competition law, basic law adjustments and sources of the Competition law, the general Unfair competition clause. 2. Factual principles of the Unfair competition & other unfair competition behaviour I. 3. Factual principles of the Unfair competition & other unfair competition behaviour II. 4. Legal protection recourses against the Unfair competiton and Unfair business practise. 5. Common questions of the protection law of the economic competition. Restrictions and regulations in the Economic competition protection law, distortion of competition through illegal agreements, abuse of a dominant position and competitors integration. Procedural Law of Unfair Competition Disputes 6. Compensation for competition damage BLOCKS Block teaching plan for teaching the subject in the academic year 2021/22: Introductory block: 22.10.2021. Blocks with seminar parts: 05.11.2021, 19.11.2021, 03.12.2021. ATTENDANCE NOT REQUIRED Attendance at the seminar (in the building of Faculty of Law Palacky University Olomouc) is NOT REQUIRED. If technically possible, all teaching carried out in the building of Faculty od Law Palacky Univesity Olomouc will ALSO BE ACCESIBLE via the Internet (ZOOM). TASKS: Tasks are always assigned on the date of teaching, the possibility of fulfillment until 16.11.2021, 30.11.2021 resp. 14.12.2021 The big task will be assigned on 17.12.2021 with the possibility of fulfillment until 04.01.2022. Subject to change due to force majeure (eg illness).

Learning outcomes
|
Students will be acquainted with the basic areas of the Competition law, its history, sources, institutions and the application routine. The attention will be paid to the civil questions (Unfair competition, factual matter, results of Unfair competition behaviour, Unfair competition control) as well as the public-legal questions - especially the Economic competition protection, its institutions, basic proceedings, processes in the Economic competition, the application routine. The Unfair business practises will be mentioned also. Individual sections will be integrated and other related questions will be discussed in a wider context (e.g. advertising public-legal regulation). The subject innovation has been supported by the project Support of Interdisciplinary studies and Study Programmes Innovations at Palacký University in Olomouc, CZ.1.07/2.2.00/28.0091.
Students who have completed this course will gain the knowledge and skills necessary to classify unfair competition behaviour and distortion of competition, factual matter of such behaviour, eventually the claim determination to an entitled person. Students will be able to discribe results of the Unfair competition behaviour in the pulic-legal and civil point of view.

Assessment methods and criteria

CREDIT (ZÁPOČET) To obtain the credit, it is necessary to obtain at least 3 of the total possible 6 points for processing tasks. Submission of one's own solution of the task is considered as active participation of the student in teaching. Assignment of tasks and submission of their solution through technical means of distance communication reserved for this guarantor (support of the EDIS portal (edis.upol.cz - support of COMPETITION LAW (NSOUP 21/22 <> 20/21)). For completing the tasks related to the individual blocks of teaching (small task 1/2/3) it is possible to get 1 point for solving each small task, for completing the "Big task" it is possible to get 3 points. The condition for granting the credit is to obtain at least 3 of the total 6 points that the student can obtain for solving tasks. Submit the solution of the task in the coming deadlines: Task designation - Date of task assignment - date of task completion - maximum number of points obtainable - note Small task 1 - 05.11.21 - 12.11.21 - 1 - task submission is NOT PERMITTED Small task 2 -19.11.21 - 26.11.21 - 1 - task submission is NOT PERMITTED Small task 3 -03.12.21 - 10.12.21 - 1 - task submission is NOT PERMITTED Big task - 17.12.21 - 04.01.22 - 3 - submission of the task after the deadline IS PERMITTED The points awarded for solving the accepted tasks are included in the overall evaluation of the subject (for the purposes of the exam). The exam is written - in the EDIS environment. The questions are theoretical and theoretical-application. They are aimed at verifying the knowledge acquired in the subject of Competition Law. The student is obliged to work with the study support for the subject after its access in the e-learning environment EDIS (edis.upol.cz).
