Lecture Topics: Introduction to civil procedure, basic principles, legal regulation Subjects of civil procedure (Public prosecution, Financial Prosecution) Civil jurisdiction - competence and internal jurisdiction Participants - definition, capacities of participants, representation of participants Participants - joinder of parties, justiciability, intervening in proceedings and interchange of participants, collateral participation in proceedings, principal participation in proceedings, procedural succession Procedural acts of the court and participants Conciliation proceeding and securing proceeding Right to a fair trial, commencement of civil proceedings Action and its elements Preparation of hearing, procedural conditions Hearing, concentration of the proceeding, duty of the court to instruct Bar to the course of proceedings The evidence proceedings Decision - forms, types Legal force and enforceable decision Court costs Seminar topics: Introduction to civil procedure, types of civil procedure Basic principles of civil proceedings The judiciary. The obligatory subject Civil procedure provides students with the basic knowledge about the civil procedure as a process of court and other procedural subjects when providing protection to endangered and violated rights following from civil relationships. It is conceived as a three semester subject. The first semestr is dedicated to the contentious proceedings, the second then to remedies, enforcement and bankruptcy and the third finally to non-contentious proceedings. The subject innovation has been supported by the project Support of Interdisciplinary studies and Study Programmes Innovations at Palacký University in Olomouc, CZ.1.07/2.2.00/28.0091.
Students who have completed this course will gain elementary knowledge in the field of civil procedure, which may serve as base for the wider and deeper study of this topic in the next two semesters.

Completion of this course is not conditional upon completion of some other courses.

Assessment methods and criteria
|
Written exam
It is essential that those students who would like to pass the course must have attendance within the scope set by the seminar teacher and they also must write the civil action, succeed in the theoretical and practical exam and succeed in the colloquium. The student is required to work with the learning objects, which have been created for the concrete subject and are available for authorized students in LMS EDIS.
