Course content
I. Human rights mechanisms at EU level The section defines human and fundamental rights, their classification and specific anchoring in EU law. The focus is on the EU Charter of Fundamental Rights, its structure, legal bindingness, horizontal provisions, distinction between rights and principles and possibilities of judicial enforcement. It also covers the EU concept of the rule of law, mechanisms for its protection, including Article 7 TEU, conditionality of the use of funds and infringement proceedings, as well as the development of the case law of the CJEU, relations with national constitutional courts and the social dimension of the protection of rights in the EU. II. The EU and the human rights mechanisms of the Council of Europe This section analyses the ECHR, its catalogue of rights, scope and the Strasbourg control system led by the ECtHR. It requires mastering the individual complaint, the conditions of admissibility, domestic remedies and the supervision of the execution of judgments by the Committee of Ministers, including the institutional changes brought about by Protocols Nos. 14, 15 and 16. Also important are the relations between EU law and the ECHR, the problem of the EU's accession to the Convention, Opinion 2/13 and the protection of social rights under the European Social Charter.
