Course content
|
1. The Constitutional foundation of the EU membership from the comparative viewpoint - so called Euro Articles contained in the Constitutions of member states, integration clauses, incorporation clauses. 2. Constitutional amendments resulting from the EU membership - proposals of constitutional amendments, so called Constitutional Euro Amendment. 3. The interpretation of the Constitutional Euro Amendment based on the judicial decision of the constitutional Court - the interpretation article 10a of the Constitution. 4. The relation between the EU law and the Constitutional laws of the member states from the supranational viewpoint - the analysis of the rulings of the European Court of Justice 5. The relation between the EU law and the national laws from the national perspective - the comparison of the approaches of the Constitutional Courts' (Supreme Courts') of the EU member states. 6. The relation of the EU law and the Czech law found in the judicial decisions of the Constitutional Court - the relation between the EU law and the case law, the relation between the EU law and the Constitutional law, the delegation of powers from the member states to the EU and its limitations. 7. The role of the Constitutional Court and the courts of general jurisdiction in the application of the EU law. 8. The relation between the Constitutional Court and the European Court of Justice - the proceedings on preliminary issues from the viewpoint of the Constitutional Court. 9. The influence of the European integration and the EU law upon the conception and interpretation of the selected Constitutional institutes. 10. The sovereignty of the Czech Republic and the European integration. 11. The relation bewteen the EU and the member states as a part of a wide theoretical analysis - federalism and the European Union, the theory of the Constitutional pluralism, " multilevel constitutionalism, etc. 12. The relation between the international and national law - the perspective of the international law. The observation of international law obligations. 13. The relation between the international and national law - the perspective of national law. he observation of international law obligations. 14. Historical development of the relations between the Czech and International law. 15. The Euro Amendment of the Constitution of the Czech Republic - the international case law and the national law, Presidential Contracts, Governmental and Resort Contracts. Self-execution of the international treaties. 16. The position of the human rights international treaties in the Czech legal order. 17. The position of Treaties under the article 10a of the Constitution of the Czech Republic. 18. Preliminary control of the constitutionality of international treaties. 19. The national law of the international treaties. 20. The presentation of the state in the international relations.

The aim of the subject called Constitutional aspects of European and International law is to analyse the mutual proportion between the EU law, or International law and the national law, that is the Czech law especially. As far as the issues of EU law are concerned the subject is specifically focused on the introduction of the Constitutional implications brought about as a result of the Czech membership in the EU. Those students who complete this subject will acquire knowledge essential for a better understanding of the functioning and limitations of the integration processes from the viewpoint of the Czech Republic, including the comparative viewpoint, when talking about the other EU member states. Those who decide to sign up will also gain useful skills necessary for handling sources and judical decisions of the Constitutional Court concerning so called European issues.
