Course content
1. Basic sources and nature of international, European and national law. 2. Definition and status of refugee under the Convention 3. Common European asylum system 4. Asylum treatment according to the Qualification Directive, subsidiary protection. 5. UNHCR 6. Foreigner's entry into the territory, protection of external borders, the issue of free movement of persons within the EU. 7. Residence of a foreigner in the territory - categorization of types of residence and their purpose 8. Administrative expulsion. Return Directive and regulation in the Act on the Residence of Aliens. Guarantee of the principle of non-refoulement. 9. Return policy of the EU and the Czech Republic, voluntary returns, implementation of forced returns - legislation and practice in the Czech Republic, return operations of Frontex. 10. Detention - administrative detention of foreigners for the purpose of administrative expulsion or transfer to another state. Specifics of securing families with children in a migratory situation, material conditions of detention according to human rights standards, situation in the Czech Republic. 11. The status and protection of the rights of unaccompanied minors, the situation in the Czech Republic and Europe, the issue of age determination and guardianship in proceedings under the Asylum Act and the Act on the Residence of Aliens. 12. Definition and protection of the rights of stateless persons according to the Convention on the Status of Stateless Persons (1954), situation and legislation in the Czech Republic.

Learning outcomes
The aim of the course is to introduce students to the basics of asylum and migration law at the level of international, European and national legal regulations. All three levels are closely intertwined in a given area of legal regulation. The course will acquaint students with the basic legal regulations affecting the area of migration, both in terms of forced migration (refugee and asylum issues, subsidiary and temporary protection, Common European Asylum System), and in terms of voluntary migration (individual types and purposes of foreigner's residence) to the territory and their legal regime, the legal regulation of migration of EU citizens and their family members and the regulation of migration of citizens from third countries). Other related topics will include issues of administrative expulsion and detention of foreigners, return policy and the specifics of the position of some vulnerable groups of foreigners (migrant families with children, unaccompanied minors, stateless persons).
At the end of the course students should be able to understand the main sources of legal regulation of asylum and migration, they will know their basic content and will be able to interpret them in their mutual relations.
