Course content
Topics of the lectures: 1. Theoretical sources of extrajudicial methods, interdisciplinary conception, terminological clarification, subject of solution (conflict - conflict, characteristics) 2. Types and characteristics of out-of-court dispute resolution methods 3. Negotiation - sources, development, principles, characteristics 4. Mediation - sources, development, principles, characteristics, models of mediation, legal regulation 5. Arbitration - sources, development, characteristics, arbitrability, types of arbitration, legal regulations 6. Collaborative law - sources, development, characteristics, team dispute resolution 7. Prospects for the development of out-of-court dispute resolution methods Topics of the seminars: 1. Social, legal, psychological and ethical aspects of out-of-court dispute resolution methods, types of conflicts, phases development of conflicts 2. Types of out-of-court dispute resolution methods - overview and characteristics, choice of appropriate dispute resolution method 3. Negotiation - phases, areas of utilization, experience in the Czech Republic and abroad 4. Mediation - participants, phases, outcomes of mediation, areas and forms of utilization, experience in the Czech Republic and abroad 5. Arbitration - Arbitration Proceedings, Arbitrator, Arbitration Agreement, Fields of Use, CR and abroad 6. Right of cooperation - process, participants, co-operating attorney and his / her role, disqualification clause, experience in the Czech Republic and abroad 7. Systems for the practical application of out-of-court dispute resolution methods

Learning outcomes
The course mainly focuses on getting knowledge of out-of-court methods of dispute resolutions that are based on the consensus and conciliatory approach. It acquaints with the theoretical background, development and current state of use, provides an overview of individual methods, their legal anchoring, characteristics and areas of use. Emphasis is placed on interdisciplinary concepts. Wider attention is paid to methods of negotiation, mediation, arbitration and cooperation law, including their legal regulation and systems of practical application. The party does not have experience from practice in our country or abroad, and perspectives of further development. The subject gives an overview of other dispute resolution options and creates a broader foundation for the profession.
Students gain necessary knowledge of the out-of-court/alternative dispute resolution. They will get overview of different methods and its legal aspects. They will be able to identify a conflict and find the appropriate strategy. They will improve their knowledge and acquire skills for conciliatory dispute resolution, through the fulfilment of the tasks given on the seminars.

Students are required to actively participate on the seminars, to fulfill the tasks given by the lecturer and to pass the final colloquium.
