Course content
The course presents students with proven tools, which it presents as friendly solutions to conflict situations. It aims to help to master the given methods such as negotiation, conciliation, mediation procedures, etc. in their basic application schemes. The course responds to the need that arises in connection with the nature of the exercise of their future professions. Techniques and their methodological and legal frameworks will be developed and adapted to this need, making graduates better prepared both for conflicts between clients and for conflicts that arise with clients themselves. The course introduces the basic paradigm of conflict resolution and perspectives on dispute resolution in the dispute resolution system. It introduces the procedures for creating the preconditions for possible dispute resolution. Emphasizes aspects of confidentiality and non-disclosure, including ethics and standards for independent third party work. The nature of agreements and their meaningfulness. Ability to structure and lead a conflict resolution process. Course content - lecture topics: 1. Theoretical foundations of out-of-court dispute methods, interdisciplinary concept, terminological clarification, subject of resolution (dispute conflict, characteristics) 2. Types and characteristics of out-of-court methods of dispute and conflict resolution 3. Negotiation - sources, development, principles, characteristics 4. Mediation - sources, development, principles, characteristics, mediation models, legal regulation 5. Arbitration - sources, development, characteristics, arbitrability, types of arbitration, legislation 6. Prospects for the use of methods and procedures used in out-of-court dispute resolution 7. Concept of legal regulation and legal consequences of out-of-court dispute resolution - summary 8. Ethics of mediator's work Seminar topics: 1. Social, legal, psychological and ethical aspects of out-of-court dispute resolution methods, types of conflicts, stages of conflict development 2. Types of out-of-court dispute resolution methods - overview and characteristics, choosing the appropriate dispute resolution method 3. Negotiation - phases, areas of application, experience in the Czech Republic and abroad 4. Mediation - participants, phases, mediation outcomes, areas and forms of use, experience in the Czech Republic and abroad 5. Arbitration - arbitration process, arbitrator, arbitration agreement, areas of use, experience in the Czech Republic and abroad 6. Alternative processes, participants, cooperating subjects, experience in the Czech Republic and abroad 7. Systems of practical application of out-of-court dispute resolution methods in practice and their legal implications

Learning outcomes
The goal of the course is to enable students to recognize and expand their own potential for core competencies, i.e., the characteristics, motives, attitudes, knowledge, and skills of friendly and appropriate dispute identification and resolution practices, and to teach them how to use these resources to achieve effective performance as an independent third party or involved in their own conflict situation, with an emphasis on conciliatory and mediation techniques in business dealings. To familiarize them with what ADR is in terms of applied methods and out-of-court dispute resolution, what the processes are and what characterizes their regime. In an experiential way, to let them try out in model situations the different roles in settling disputes and crisis situations and to experience the process in which a party to a conflict becomes a co-creator of an agreement.
The graduate will gain knowledge about conflict and methods of its constructive resolution. He/she will be able to establish a respectful and trusting relationship with clients, structure the process and lead it using active listening and negotiation techniques. He/she will have an overview of the areas of application of ADR and know the specifics of mediation.

The student organizes his/her studies on the basis of the distance learning support - study materials and instructions in the LMS; he/she participates in announced webinars and completes continuous short tests (max. 4).
