Course content
|
1. Convention and Protocol relating to the status of refugees - definition of the term refugee, principles of refugee law. 2. Common European Asylum System and its reflections in legal framework of Czech Republic. 3. Distinctions between asylum and subsidiary protection. 4. Administrative procedure for granting international protection and following court proceedings concerning a complaint against a decision of an administrative authority. 5. Judicature of European Court of Human Rights and Court of the Justice of the European Union; refugee law - recent and future developments (internally displaced persons, war refugees, environmental refugees etc.). 6. Case study.

Learning outcomes
|
This course is taught in the form of seminars linked with practice. In the practical part of the course, students will visit a refugee camp, help with providing legal assistance, analyze practical cases, research information about the country of origin, prepare procedural documents, and will have an opportunity to participate in a refugee law moot court.
Students will aplly this knowledge to practical situations. They will develop the skill of legal analysis, drafting and document analysis, communication and presentation skills, problem-solving and legal research.

Prerequisites
|
In this subject, the students will deepen their knowledge of public international law and administrative procedure. They will also further develop knowledge of refugee law, acquired in the course Legal Clinic of Refugee and Alien Law I.

Assessment methods and criteria
|
Student performance
In order to sign-up for the course Legal Clinic of Refugee and Alien Law II, students have to pass the course Legal Clinic of Refugee and Alien Law I. The requirements to pass the course are active participation in classes, proper preparation for classes, delivering the mid-term tasks and semestral project, which may be replaced by participation in the Asylum Law Moot Court Competition.
