Course content

Topics: 1. - 2. Constitutional and lawful foundations of norm creation in public administration. Introduction to the problems of this course, introduction to the basic literature and the sources of law of this section. Constitutional and legal pre-conditions for norm creation on the local level of public administration. Self-administration and law-making. Derived norm creation, concept, characteristics. Statutory instruments, the meaning and task of these instruments and the agreement with the law. The relation between normative and governing activity in public administration. 3. - 4. The process of creation of legal regulations in public administration. Legislative entities from the general viewpoint. Law-making entities, specifics in the field of public administration, legislative authority - the state administration sector and the sector of local self-administration. Methodology of creation of legal regulation. Legislative process, concept, characteristics, legislative intent, suggestion, circulation of a draft bill for comments, hearing, approving, announcement, validity, effect, change, termination of legal regulation, files, accessibility of a legal regulation for the addressee, the problems of distant access to the legal regulations of local public administration. 5.-6. Technical legislative rules. Supervision over creation of norms in public administration. Specifics in creation of bylaws with respect to the execution of self-administration of public corporations, the problems of imposition of duties for entities. Presumption of law for issuing orders on the level of local state administration. Legislative technology of creation of bylaws and decrees, communication, comprehensibility, system of legal regulation, headline, introductory clause, amendment, citation, abbreviations. The problems of punitive provisions/the problems of penalty clauses. Supervision over norm creation. The Constitutional Court and local norm creation.

Learning outcomes
|
The aim of this course is to provide the students with theoretical knowledge and practical abilities in the area of law-making especially on the territorial public administration level, i.e. on the level of municipalities and regions. The students' theoretical foundation will be extended by means of information from the judicial decisions (especially the decisions of the Constitutional Court), by means of solving practical cases and training in writing legal regulations. The classes will be in the form of seminars. The subject innovation has been supported by the project Support of Interdisciplinary studies and Study Programmes Innovations at Palacký University in Olomouc, CZ.1.07/2.2.00/28.0091.
Students who have completed this course will gain theoretical knowledge.

Assessment methods and criteria
|
Seminar Work
It is essential that those students who would like to pass the course must have attendance within the scope set by the seminar teacher and succeed in the colloquium. The student is required to work with the learning objects, which have been created for the concrete subject and are available for authorized students in LMS EDIS.
