Learning outcomes
|
The course will introduce students to one institute of the law of damages, which will be analyzed in detail in different legal systems. This institute varies from semester to semester. The course will thus provide an overview of how the issue is dealt with in different legal systems, how these solutions differ or how they are similar. The emphasis is on the applicability of this knowledge to work with the Czech legal order. The students will divide the different legal systems and prepare basic studies on them, which they will introduce to the other students. The second part of the seminar will be a discussion of the given legal order and a comparison with Czech law and with the legal orders discussed in previous seminars. The basic sources on which students draw are the so-called national reports written in English, which are contained in specialised publications issued by international research teams (in particular publications of the European Centre of Tort and Insurance Law).
Students will learn about the different approaches of foreign legal systems to dealing with sub-issues of the law of damages, which will enable them to get to know their own system better.

Active participation of students in seminars is required. Students will also give one presentation during the semester related to their assigned law.
