Course content
Contents 1. The subject of Constitutional law, the sources of Constitutional Law 2. Termination of Czechoslovak Federative Republic, creation of the Czech Republic, continuity and reception of law, constitutional order 3. Conception of the Czech Constitution, preamble and the basic provisions of the Constitution (The Czech Republic as a democratic and law abiding state, division of powers, rigidity of the Constitution, irreversible provisions and material core of the Constitution, political plurality) 4. Relation between national law and international law (international law reception - incorporation, transformation, adaptation), general incorporation - article 10, international treaties approving, international treaties application, authorities of law application in the Czech Republic, the Constitution and European Law - article 10a, European Law application by means of national authorities 5. Citizenship (acquiring, losing), legal status of foreigners 6. The Legislative Branch, bicameralism, relations between the chambers, the powers of the Parliament, MPs' legal position - mandate, immunity, the relation towards the other branches of power 7. The Executive, The Government (creation, confidence, resignation), constitutional fundamentals of ministries and other authorities of the Executive, prosecuting attorney's office; the relation towards other branches 8. The President of the Republic - powers, creation, responsibility, position within the system of division of power, nature of acts 9. Direct and representative democracy in the Czech Republic, the basic electoral principles and the principles of electoral law 10. Judicial Branch, constitutional fundamentals of the organization of judicial power, judges' and judicial officials' creation, responsibility, independence and impartiality of judicial branch - the position of judiciary within the system of division of power, constitutional fundamentals of judicial proceedings - the right to judicial protection 11. Constitutional judiciary, constitutional court - organization, powers, creation, position among the branches 12. The territory of the Czech Republic, Czech borders, administrative and self-administrative division of the territory, constitutional fundamentals of territorial self-administration 13. State security, emergencies (belligerency, the state of endangering the country, emergencies), influence on other areas of state functioning - legislative process, rights restriction

Learning outcomes
The aim of this subject is to introduce the students to the constitutional fundamentals of organization and functioning of the state (the Czech Republic), the sources of constitutional law, the internal state organization, constitutional enshrinement, powers and mutual relations of supreme state authorities, the horizontal and vertical division of power, representative and direct democracy, the relations between the Czech Republic and other states, the relations between the Czech Republic and the international community and the problems of emergencies. The internal regulation prohibits repeated registration for this course.
Students who have completed this subject will gain the knowledge and skills concerning the description and analysis of the basic constitutional concepts and institutes as well as the functioning of the state mechanism of the Czech Republic.

There are no prerequisites for this course.

Assessment methods and criteria
Mark

In order to get the credit it is essential that the students should attend the seminars, complete the tasks assigned by the seminar leader and pass/be successful at the written test. Those students who would like to take the exam must first get the credit. The student is required to work with the learning objects, which have been created for the concrete subject and are available for authorized students in LMS EDIS.
